01About OUM Radio

1UP Music is the full name of OUM (One Up Music); OUM Radio, 1UP Music and OUM are the same platform ("the Service"), operated by FizzNetwork, a UK-based independent developer platform. These terms apply equally to the 1UP Music app on the Solana dApp Store and to OUM Radio. The Service is available at music.1upnetwork.xyz, oum.1upnetwork.xyz and oumradio.xyz, via downloadable desktop and mobile applications, and as an embeddable web widget.

OUM Radio enables listeners to stream underground and independent music, and enables artists to upload, distribute, and mint their music as NFTs on the Solana blockchain.

02Eligibility

You must be at least 13 years old to stream music on OUM Radio. To connect a wallet, mint or collect NFTs, earn or claim tokens, or make payments, you must be at least 18 years old. By using those features you confirm you meet this requirement. If you are between 13 and 18, you may use listening features only with the permission of a parent or guardian.

03Listener Terms

As a listener you may:

• Stream music available on OUM Radio for personal, non-commercial use.
• Connect a Solana wallet to access XP rewards, token claims, and NFT collection features.
• Embed the OUM Radio widget on your own website or project.

You may not:

• Reproduce, redistribute, or publicly broadcast content from OUM Radio without permission from the rights holder.
• Attempt to scrape, download, or capture audio streams for redistribution.
• Use the Service in any way that violates applicable law.

04Artist Terms & Content Upload

By uploading content to OUM Radio, you confirm that:

• You own or have full rights to the audio, artwork, and metadata you upload.
• Your content does not infringe the copyright, trademark, or other rights of any third party.
• Your content does not contain unlicensed samples, interpolations, or copyrighted material you do not have rights to.
• You are not uploading content on behalf of a major label or distributor without their permission.

You retain full ownership of your content. By uploading, you grant OUM Radio a non-exclusive, royalty-free licence to host, stream, display, and distribute your content on the platform and via the embed widget.

OUM Radio reserves the right to remove any content that violates these terms or applicable law, without notice.

05NFT Minting & Solana Blockchain

OUM Radio provides tools for artists to mint music NFTs on the Solana blockchain. By using these tools:

• You accept full responsibility for all on-chain transactions initiated through your connected wallet.
• You understand that OUM Radio does not control the Solana network and cannot reverse transactions.
• You acknowledge that NFT values are not guaranteed and may fluctuate or become worthless.
• You are responsible for the security of your own wallet and private keys. OUM Radio never has access to your private keys.

06OUM Tokens & XP

OUM Radio may offer token rewards, XP, or other digital incentives as part of the platform experience. These are subject to change at any time. OUM Radio makes no guarantee of the value, availability, or continuity of any token or reward system.

Tokens and XP earned on OUM Radio are for platform use only and do not constitute financial instruments or securities.

07Prohibited Conduct

You may not use OUM Radio to:

• Upload, share, or distribute content that is unlawful, hateful, or infringing.
• Attempt to hack, disrupt, or degrade the performance of the Service.
• Circumvent any access controls, wallet verification, or content restrictions.
• Impersonate another artist, user, or entity.
• Use automated bots or scripts to inflate plays, XP, or token claims.

08Donations

Voluntary donations made via Stripe or Solana wallet are non-refundable. Donations support the operation of OUM Radio and do not entitle the donor to any ownership stake, service guarantee, or special privileges beyond those explicitly offered at the time of donation.

09Disclaimers & Limitation of Liability

OUM Radio is provided "as is" without warranties of any kind. FizzNetwork does not guarantee uninterrupted access, error-free operation, or the continued availability of any feature.

To the fullest extent permitted by law, FizzNetwork shall not be liable for any indirect, incidental, or consequential damages arising from your use of OUM Radio, including losses related to blockchain transactions, digital assets, or content uploaded to the platform.

10Termination

FizzNetwork reserves the right to suspend or terminate access to OUM Radio for any user or artist who violates these terms, at our sole discretion and without notice.

You may stop using OUM Radio at any time. Disconnecting your wallet removes your active session. On-chain data cannot be removed.

11Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12Changes to These Terms

We may update these terms as OUM Radio evolves. The "last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after changes constitutes your acceptance of the updated terms.
